1. Introduction
This website, regenperformance.com.au (the "Site"), is owned and operated by Regen Performance ("Regen", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Site and any purchase of Regen products, apparel, or accessories (the "Service"), and apply to all visitors, customers, and other users of the Site.
By browsing the Site or placing an order, you agree to be bound by these Terms, including any policies referenced in them (including our Privacy Policy, Returns Policy, and Shipping & Delivery policy). If you don't agree with these Terms, please don't use the Site or place an order.
We may update these Terms from time to time by posting a revised version on the Site. It's your responsibility to check back periodically — continuing to use the Site or placing an order after changes are posted means you accept the updated Terms.
2. Who Can Use This Site
By using the Site, you confirm that you have the legal capacity to enter into a binding contract in your state, territory, or country of residence (or, if you're using the Site on behalf of a minor dependant, that you have their parent/guardian consent to do so). You agree not to use the Site or our products for any unlawful purpose, or in a way that breaches any law applicable to you, including intellectual property and consumer protection laws.
3. Our Platform
Our Site is hosted on Shopify Inc., who provide the e-commerce platform used to process orders and payments. Shopify's own terms and privacy practices also apply to aspects of the checkout process — see Shopify's terms for details.
4. Orders and Pricing
All prices on the Site are listed in Australian Dollars (AUD) and, where applicable, are inclusive of GST.
We reserve the right to refuse or cancel any order, at any time, for any reason — including suspected fraud, pricing or listing errors, or where we reasonably believe an order is intended for wholesale resale rather than personal use. If we cancel an order after payment has been taken, we'll refund you in full.
Product prices, descriptions, and availability are subject to change without notice, and we may discontinue any product at any time. We won't be liable to you or any third party for any such change, price update, or discontinuation.
We make reasonable efforts to display our products, packaging, and colours accurately, but we can't guarantee your device's display will be fully accurate, and actual packaging or labelling may vary slightly over time.
From time to time the Site may contain typographical errors, inaccuracies, or omissions relating to pricing, promotions, or product information. We reserve the right to correct these and, where necessary, to cancel an affected order — even after it's been submitted or confirmed — without prior notice. If we cancel your order for this reason, we'll notify you and refund any amount paid.
It's your responsibility to keep your account, billing, and contact details current and accurate so we can process your order and contact you if needed.
5. Product Use & Health Information
Regen products are dietary supplements, not medicines, and are not intended to diagnose, treat, cure, or prevent any disease. Always read the label and follow the directions for use. Consult a healthcare professional before use if you're pregnant, breastfeeding, taking medication, or have a pre-existing medical condition, and stop use and seek medical advice if you experience an adverse reaction.
General information on the Site (including product descriptions and any nutritional or training content) is provided for general informational purposes only, is not personalised advice, and shouldn't be relied on as a substitute for professional medical or dietetic advice.
6. Promotions
Promotional offers (such as spend-and-save deals or discount codes) are available for a limited time or while stocks last, and are subject to any specific terms stated with the offer. Unless stated otherwise: one promotional item per customer; the qualifying spend is calculated after any discount codes are applied; offers can't be redeemed for cash or exchanged for other items or raincheck; and promotional items received with an order are not eligible for change-of-mind return or exchange, consistent with our Returns Policy.
All promotions run at our discretion, and we may change or end a promotion at any time without notice.
7. Acceptable Use
You agree not to use the Site to:
● break any applicable law or regulation;
● infringe our intellectual property or anyone else's;
● harass, defame, or discriminate against any person;
● submit false, misleading, or fraudulent information (including impersonating someone else);
● upload viruses or other malicious code, or attempt to interfere with the security or functioning of the Site;
● scrape, crawl, or harvest data from the Site, or collect other users' personal information; or
● resell or commercially exploit the Site or its content without our written permission.
We may suspend or terminate your access to the Site or Service if we reasonably believe you've breached these Terms.
8. Your Feedback and Content
If you send us feedback, reviews, testimonials, or ideas (for example, in response to a survey or a social media post), you agree we can use, edit, publish, and share that content in connection with our business, without any obligation to pay you or keep it confidential. You're responsible for making sure anything you send us doesn't infringe someone else's rights or contain unlawful or offensive material.
9. Third-Party Links
The Site may link to third-party websites or contain third-party content. We don't control and aren't responsible for the content, accuracy, or practices of any third-party site, and linking to it doesn't mean we endorse it. Any dealings you have with a third party found through our Site are solely between you and that third party.
10. Intellectual Property
The Regen name, logo, product names, and Site content (including text, graphics, and images) are owned by us or our licensors and protected by intellectual property law. You may not copy, reproduce, or use them without our prior written permission, except as necessary to browse the Site or place an order in the ordinary course.
11. Your Consumer Guarantee Rights
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy available to you under the Australian Consumer Law or any other law that can't be lawfully excluded. Where our liability can be limited under that law, it's limited to (at our option) replacing the goods, supplying equivalent goods, repairing the goods, or paying the cost of doing so.
12. Disclaimer & Limitation of Liability
Subject always to Section 11 above, the Site and Service are provided on an "as is" and "as available" basis, without warranties of any kind except as expressly stated in these Terms or required by law. We don't guarantee the Site will be uninterrupted, secure, or error-free.
To the maximum extent permitted by law, and subject to your non-excludable rights under the Australian Consumer Law, Regen and our directors, employees, and suppliers won't be liable for any indirect, incidental, or consequential loss (including lost profits or data) arising from your use of the Site or our products, even if we've been advised of the possibility of that loss.
13. Indemnity
You agree to indemnify Regen and our officers, employees, and agents against any claim or expense (including reasonable legal fees) arising from your breach of these Terms or your breach of any law or third party's rights, except to the extent caused by our own negligence or breach of these Terms.
14. General
Severability: if any part of these Terms is found unenforceable, the rest will continue to apply.
No waiver: if we don't enforce a provision, that doesn't mean we've waived our right to do so later.
Entire agreement: these Terms, together with our Privacy Policy, Returns Policy, and Shipping & Delivery policy, make up the entire agreement between you and us regarding the Site, replacing any earlier versions or understandings.
Termination: you can stop using the Site at any time. We may suspend or terminate your access for a breach of these Terms; obligations that reasonably should survive termination (like payment or indemnity obligations) will continue to apply.
Governing law: these Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of its courts.
