Regen Performance ("Regen", "we", "us", "our") sells performance supplements and related products directly to consumers through regenperformance.com.au. We market to our customers and subscribers through channels including email, SMS, and online advertising.
Protecting your privacy matters to us. This policy explains what personal information we collect, why we collect it, how we use and share it, and the choices and rights you have. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
Information We Collect
We collect personal information that is reasonably necessary for us to run our business and serve you well, including to:
● fulfil and deliver your orders;
● respond to your enquiries, requests, and complaints;
● run and improve our website, products, and marketing; and
● keep our records of you accurate and up to date.
This is generally collected directly from you — for example, when you create an account, place an order, subscribe to our emails or texts, enter a competition, or contact our support team. We may also collect information automatically through your use of our website (see Cookies & Online Tracking below), and occasionally from third parties such as our delivery partners, payment processor, or publicly available sources.
The personal information we typically hold includes:
● identity and contact details — name, email address, phone number, delivery and billing address;
● order and transaction history, and any product or delivery preferences you tell us about;
● account credentials, if you create a website account;
● records of your communications with us (phone, email, SMS, live chat, social media); and
● technical and browsing information collected via our website and marketing tools.
Sensitive and health-related information
Because we sell supplements, you may voluntarily tell us about dietary requirements, allergies, or health goals — for example, in a customer service enquiry. This is "sensitive information" under the Privacy Act. We only collect it where you provide it to us, we only use it to respond to your enquiry or tailor product suggestions you've asked for, and we will not use it for any other purpose without your consent.
How We Use and Share Your Information
We use your personal information for the purpose we collected it, and for other purposes you'd reasonably expect — such as processing and delivering orders, providing customer support, preventing fraud, and improving our products and website.
We do not sell your personal information to third parties. We may share it with:
● service providers who help us run our business — for example, our e-commerce platform, payment processor, delivery couriers, email/SMS marketing platform, IT hosting, and customer support tools;
● professional advisers, such as our accountant or lawyer, where reasonably necessary;
● a buyer or prospective buyer, if we sell or restructure our business, on a confidential basis; and
● government or regulatory bodies, where required or authorised by law.
We will only use your information for another purpose with your consent, or as otherwise permitted by law.
Marketing — Email & SMS
If you subscribe to our newsletter, create an account, or provide your phone number at checkout, we may send you marketing communications about products, promotions, and offers by email and SMS, consistent with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth). Providing your details does not obligate you to purchase anything, and consent to marketing is never a condition of buying from us.
Every marketing email and SMS we send includes a simple way to opt out — an unsubscribe link in emails, or by replying STOP to any text message. We'll process opt-out requests promptly. You can also contact us directly (see Contact Us below) to update your preferences. Note that transactional messages — such as order and delivery updates — are not marketing and will continue regardless of your marketing preferences, as they relate to orders you've placed.
Cookies & Online Tracking
Our website uses cookies and similar technologies to remember your preferences, keep you logged in, understand how visitors use our site, and measure and improve our advertising.
We use third-party advertising and analytics tools — such as the Meta (Facebook/Instagram) Pixel and Google Ads/Analytics — to show you relevant ads on other websites and platforms based on your visit to our site, and to understand the performance of our marketing. These providers may set their own cookies and collect information about your browsing across sites; this is generally not information that identifies you personally, though it may be combined with information you've given us to help tailor what you see.
You can control or disable cookies through your browser settings, and opt out of interest-based advertising through the Network Advertising Initiative (networkadvertising.org/choices) or your device/platform ad settings. If you block cookies, some parts of our website may not work as intended.
Where Your Information Is Held
We use reputable third-party platforms to run our business — for example our website/e-commerce platform and our email/SMS marketing platform — some of which store or process data on servers located outside Australia, including in the United States. Before we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles, including relying on the provider's own security and privacy commitments.
Keeping Your Information Secure and Accurate
We take reasonable technical and organisational steps to protect the personal information we hold from misuse, interference, loss, and unauthorised access, modification, or disclosure — including restricting access within our business and requiring our service providers to protect it appropriately.
We hold information only for as long as we reasonably need it for the purposes described in this policy, or as required by law (for example, tax and business records), after which we securely delete or de-identify it.
We take reasonable steps to keep the personal information we hold accurate, complete, and up to date. If any of your details change, you can update them via your account or by contacting us.
Accessing or Correcting Your Information
You can ask us for access to, or correction of, the personal information we hold about you at any time by contacting us (see below). We'll usually respond within a reasonable period and won't charge you for a straightforward request. In limited circumstances permitted by law we may need to decline a request — if so, we'll explain why. If you disagree with a decision we make about your information, you can ask us to note your objection against the record.
Children's Privacy
Our products and website are intended for adults. We do not knowingly collect personal information from children, and if we become aware that we have done so without appropriate consent, we will take reasonable steps to delete it.
Complaints
If you have a concern about how we've handled your personal information, please contact us first (see below) — we'll acknowledge your complaint, let you know who is handling it, and aim to resolve it promptly and fairly.
If you're not satisfied with our response, you have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.
Changes to This Policy
We may update this policy from time to time as our business, technology, or legal obligations change. We'll post the updated version on our website with a new "last updated" date. Please check back periodically.
